Smoke-Free England: The Law
Smoking
- Smoking is prohibited in enclosed spaces open to the public, or where more than one person is employed.
- 'Smoking' includes the presence of lit tobacco, which includes any form of tobacco.
Enclosed spaces
- 'Enclosed spaces' describes any space with a roof and more than 50% walled surroundings, including windows or doors.
- Bus shelters or existing smoking shelters could be termed an enclosed space.
Vehicles
- Smoking is prohibited in vehicles which are used for business purposes, or where the vehicle may carry a passenger in a business capacity.
Signage
- Smoke-Free signage must be displayed in a prominent position at all workplace entrances, by law.
- No Smoking signs at each area must include at least one A5 sign which includes the no smoking symbol and particular text.
Exemptions
- Permanent or temporary places of residence, including hotels, care homes, prisons (unless designated 'no smoking')
- Mental hospitals, if designated long-term
- Workplaces used for self-employment which members of the public would not access
Penalties
- For individuals - £50 (or £30 early payment discount)
- Failure to display signage - £200 (or £150 early payment discount)
- Businesses - up to £2500 for allowing smoking to take place (with no discount)
So don't get caught out - stamp out smoking sooner rather than later and prevent unnecessary fines.
